Larceny, commonly known as theft, is defined as the “taking of personal property accomplished by fraud or stealth, and with the intent to deprive another thereof” and is either charged as grand or petit larceny.

Petit larceny, or misdemeanor larceny, arises in instances where the value of the property taken is less than or equal to Five Hundred Dollars ($500.00) and is punishable by up to six (6) months in the county jail and/or a fine of $10.00 to $500.00.

Grand larceny, or felony larceny, is most often charged in instances where the value of the property taken exceeds Five Hundred Dollars ($500.00) and is punishable by up to five (5) years in the Oklahoma Department of Corrections and a fine of up to $5,000.00.

Please note that Oklahoma recognizes a special category for shoplifting or other thefts from retailers within their own ranges of punishment and habitual offender enhancement provisions. If you have been charged with Larceny of Merchandise from a Retailer it is vital that you contact criminal defense attorney Greg Lavender as soon as possible.
