Generally speaking, burglary is the crime of breaking and entering with the intent to steal or commit some other crime therein. Oklahoma law divides burglary into three categories based on what structure or object has been burglarized:

First Degree Burglary is when an individual enters the occupied home of another. Second Degree Burglary applies to unoccupied homes, commercial, buildings and other structures. Third Degree Burglary applies to automobiles, trailers and vessels.

Penalty for Burglary

Burglary in the first degree carries with it an extreme risk of death for both the perpetrator and any occupants of the home which is why it carries the harshest punishment under Oklahoma law. If convicted you will face a minimum of seven (7) years up to a maximum of twenty (20) years in the Department of Corrections and/or a fine of $10,000.

Second degree and third degree burglary are punishable by up to seven (7) years and up to five (5) years in the Department of Corrections respectively and/or a $10,000 fine.

 Proving intent can be particularly tricky for prosecutors which is why it is so important to hire a lawyer.  Only you really know what you were thinking at the time. So, without a confession, the prosecutor must rely upon circumstantial evidence.
